1. Acceptance of Terms

By accessing or using LootMitra (via web browser, Progressive Web Application, or mobile application), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please discontinue using the service.

2. Nature of the Service

LootMitra assists consumers in discovering deals, flash sales, promotional discounts, and coupons published by independent e-commerce merchants (including Amazon India, Flipkart, Myntra, boAt, Croma, Ajio, and others).

• Independent Platform: LootMitra and Mistcast are independent entities and are not directly affiliated with, sponsored by, or endorsed by the brands or merchants whose products are referenced, except through standard public affiliate partner agreements.
• AI Trust Score: Our algorithmic Trust Score and discount summaries are informational assessments calculated based on automated analysis of merchant history, price fluctuations, and catalog metrics. They are provided on an "as-is" basis for consumer guidance and do not constitute professional financial or purchasing advice.

3. Pricing & Deal Availability Disclaimer

Neither LootMitra nor Mistcast shall be held liable for discrepancies between the price displayed on our platform and the price charged by the merchant at the time of purchase, or for deal cancellations initiated by merchants.

4. Third-Party Transactions & Merchant Liability

When you click a deal link and make a purchase on a merchant site:

• The transaction is executed exclusively between you and the respective seller/merchant.
• All product guarantees, warranties, shipment logistics, order cancellations, returns, refunds, and customer support are the sole legal responsibility of the seller and merchant platform.
• Mistcast and LootMitra disclaim all liability for defective goods, non-delivery, damaged packaging, or merchant disputes.

5. Acceptable Use Policy

You agree not to:

• Use automated scripts, bots, spiders, or scrapers to extract deal data or overwhelm our server infrastructure.
• Attempt to bypass, disable, or tamper with security features, rate limits, or link-routing algorithms.
• Submit malicious, misleading, or phishing URLs into our deal converter or search bar.
• Reproduce, duplicate, copy, or resell any portion of the service for unauthorized commercial purposes without prior written consent from Mistcast.

6. Intellectual Property

All original proprietary content, software code, graphic designs, AI algorithms, and branding elements associated with LootMitra are the intellectual property of Mistcast.

Third-party brand names, trademarks, product imagery, and logos displayed on the platform are the property of their respective owners and are utilized strictly for descriptive, identification, and deal reference purposes (nominative fair use).

7. Limitation of Liability

To the maximum extent permitted by applicable law, Mistcast, its directors, developers, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, LootMitra or any merchant service linked through the platform.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to these terms shall be subject to the exclusive jurisdiction of the competent courts in India.
